1. Agreement to these terms
By creating an account or using MindMate (the "Service"), you agree to these Terms of Use and our Privacy Policy. If you use MindMate on behalf of a practice, school, company, or crisis team, you confirm you are authorized to bind that organization.
2. MindMate is not a crisis or emergency service
MindMate is a wellness support tool. It is not a substitute for professional medical advice, diagnosis, or treatment, and it does not provide emergency services. The AI chat companion is not a licensed clinician. Crisis detection, safety checks, and escalation to your care team are best-effort safety features and can miss or misjudge situations.
If you or someone else is in immediate danger, call 911 (US) or your local emergency number, or call or text 988 to reach the Suicide & Crisis Lifeline.
3. Eligibility and accounts
- You must be at least 13 years old. If you are under 18, you must use MindMate through a school program or with a parent or guardian's permission.
- Keep your login credentials confidential and tell us right away if you suspect unauthorized use.
- Provide accurate information, including when applying for professional verification.
- One person per account. Sharing accounts with others is not permitted.
4. Roles on the platform
MindMate offers different capabilities depending on your verified role:
- Individuals: check-ins, AI chat, toolkit, journal, plans, goals, therapist directory, secure messaging and video.
- Therapists and clinicians: must hold a valid license and pass verification. You are responsible for your own clinical judgment, documentation, and for meeting your professional and legal obligations, including HIPAA. MindMate reports and AI summaries are decision support only.
- School and enterprise administrators: must pass verification and may only view aggregated or privacy-protected data for people who join with your code. You agree to use the data solely for wellbeing programs and to comply with FERPA and applicable employment laws.
- Crisis / emergency teams: must be approved by MindMate administrators. You agree to respond to crisis information responsibly, to keep safety-check transcripts confidential, and to follow your own clinical and legal protocols.
5. Acceptable use
You agree not to:
- Use the Service to harm, harass, threaten, or impersonate anyone.
- Attempt to access another user's data or bypass access controls, join codes, or verification.
- Post unlawful, hateful, or sexually explicit content in community or messaging features.
- Scrape, reverse engineer, or resell the Service, or overload AI features beyond fair-use limits.
- Use MindMate to make employment, admissions, disciplinary, or insurance decisions about an individual.
6. Your content and data
You own the content you create. You grant MindMate a limited license to store, process, and display it solely to operate the Service for you and the care teams you link. Our Privacy Policy describes exactly who can see what. You can delete your account at any time from Settings.
7. Subscriptions and billing
- Free accounts include the core personal wellness toolkit. Premium, Professional, School, and Enterprise plans unlock additional features and seats.
- Paid plans renew automatically each billing period until canceled. You can cancel from the Billing page; access continues until the end of the paid period.
- Prices are shown before checkout. Promo codes apply to the period stated. Fees are non-refundable except where required by law.
- Payments are processed securely by Base44 Payments; MindMate never stores card numbers.
8. AI features
AI chat, insights, reports, and suggestions are generated automatically and may be inaccurate or incomplete. Always use your own judgment and consult a qualified professional for medical decisions. AI usage is subject to monthly fair-use limits that administrators may adjust for their members.
9. Intellectual property
MindMate, the MindMate logo, the MEII™ engine, the Wellness Orb, and all software, designs, and content of the Service are owned by MindMate or its licensors and are protected by copyright, trademark, and patent-pending rights. You may not copy or create derivative works without written permission.
10. Disclaimers and limitation of liability
The Service is provided "as is" without warranties of any kind. To the fullest extent permitted by law, MindMate is not liable for indirect, incidental, or consequential damages, or for any decision made in reliance on the Service, including its safety and crisis features. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim.
11. Suspension and termination
We may suspend or close accounts that violate these terms, misuse crisis or clinical features, or fail verification. You may close your account at any time. Sections that by their nature should survive (ownership, disclaimers, limitation of liability) will survive termination.
12. Changes and contact
We may update these terms as the Service evolves and will post the updated version here with a new date. Continued use after changes means you accept them. Questions? Open a support ticket from Support & Tutorial inside the app or via the Support link in the footer.
